Please read these terms carefully before engaging our services. They govern your use of Avemas Studios services and establish the relationship between us.
Agreement to Terms
By accessing or using the services provided by Avemas Studios, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
These Terms apply to all visitors, users, and others who access or use our services, including but not limited to website development, mobile application development, UI/UX design, and consulting services.
Our Services
Avemas Studios provides digital product development services including:
• Custom web application development
• Mobile application development (iOS & Android)
• UI/UX design and prototyping
• E-commerce solutions
• API development and integration
• Digital consulting and strategy
The scope, timeline, and deliverables for each project will be outlined in a separate project agreement or statement of work (SOW) that both parties will agree upon before work begins.
Intellectual Property
Upon full payment for services rendered:
• You will own all rights to custom code, designs, and other deliverables created specifically for your project
• We retain rights to any pre-existing code, frameworks, or tools used in your project
• We reserve the right to display completed work in our portfolio unless otherwise agreed
Any open-source components used in your project will be subject to their respective licenses. We will inform you of any such components and their licensing requirements.
Payment Terms
Our standard payment terms include:
• A deposit is required before work begins (typically 30-50% of project total)
• Milestone payments may be structured for larger projects
• Final payment is due upon project completion and before final deliverables are transferred
• Invoices are due within 14 days of issuance unless otherwise agreed
Late payments may result in work suspension and may be subject to late fees. We accept major credit cards, bank transfers, and other payment methods as agreed.
Project Timeline
Project timelines are estimates based on the agreed scope of work. Delays may occur due to:
• Changes in project requirements or scope
• Delays in receiving content, feedback, or approvals from you
• Technical challenges discovered during development
• Force majeure events
We will communicate proactively about any potential delays and work with you to minimize their impact on your project.
Revisions & Changes
Our project agreements typically include a specified number of revision rounds. Additional revisions beyond the agreed amount, or changes to the project scope, may incur additional charges.
Major changes to project requirements after work has begun may require a new project agreement or amendment to the existing SOW.
We encourage clear communication throughout the project to ensure we meet your expectations within the agreed scope.
Limitation of Liability
To the maximum extent permitted by law, Avemas Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
• Use or inability to use our services
• Any unauthorized access to or alteration of your data
• Any third-party conduct on our services
• Any other matter relating to our services
Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
Either party may terminate a project agreement with written notice, subject to the following:
• You will be responsible for payment for all work completed up to the termination date
• Any deposits for uncompleted work may be partially refundable depending on work completed
• We will provide you with all completed work and materials upon settlement
• Certain provisions (such as intellectual property and limitation of liability) will survive termination
We reserve the right to terminate services if payment obligations are not met or if these terms are violated.
